Enrollment Dispute Resolution Process

The McKinney-Vento Act's dispute resolution process involves local educational agencies (LEAs) working with families of homeless students to resolve concerns about education. The process includes mediation and the option to appeal. 
 
Dispute resolution steps
  1. The LEA McKinney-Vento liaison is contacted about concerns about a homeless student's education 
     
  2. The liaison informs the family of their rights under the McKinney-Vento Act 
     
  3. The student remains enrolled while the dispute is resolved 
     
  4. Mediation is scheduled 
     
  5. The LEA and district representative discuss the placement decision and the issue in dispute 
     
  6. If an agreement can't be reached, either party can request a review by the county homeless children education coordinator:

If the family does not find resolution they seek through Orange County Department of Education, they may appeal the county liaison's decision to the State of California Department of Education by contacting:

Dispute resolution considerations:
 
  • The LEA should make every effort to resolve the dispute locally 
     
  • The LEA should maintain a positive relationship with the student and family 
     
  • The LEA should provide written notice of the decision, including the reasons for it and the right to appeal 
     
  • The LEA should refer the family to the local liaison
